These Customer Terms are applicable to all orders and purchases made in the VERALANY website (“Products”).
With regard to the purchases made in the VERALANY website, VERALANY will communicate electronically by sending emails. You agree that all agreements, notices, disclosures and other communications that are provided electronically satisfy any legal requirement that such communications be in writing.
VERALANY may revise these Customer Terms from time to time. Any changes to the Customer Terms will apply to orders placed on or after the effective date stated in these Customer Terms or elsewhere on the VERALANY website.
Access to our Service
Access to the Services is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services we provide through the VERALANY website without notice. We will not be liable if for any reason any of the Services are unavailable at any time or for any period.
From time to time, we may restrict access to any or all of the Services.

If you decide to access any of the third-party websites linked to the VERALANY website, you do so entirely at your own risk. We accept no responsibility for third-party websites or for any loss or damage that may arise from your use of them.

Placing an Order
To be able to buy Products you must:
-read and accept these Customer Terms;
-provide your name and address, phone number, email address, payment details and other required information;
-provide an eligible delivery address (see below for further details); and
-be legally capable of entering into binding contracts, be the owner or authorized holder of a valid debit/credit card to buy the Products.
You will be provided with an opportunity to review your order(s), read and accept these Customer Terms, check the total price of your order(s) and the information you have provided and correct any input errors before confirming your order(s).
The VERALANY website currently ships to anywhere in the world excluding hotels, hostels and prisons.
Order Processing and Contract Formation
Once you have submitted and confirmed your order(s) using the VERALANY website, VERALANY will send an email to the email address you provided acknowledging receipt of your order(s) and setting out details of the ordered Product(s).
VERALANY may choose not to accept any order at VERALANY’s sole discretion including, without limitation, in the case of pricing errors, unusual orders and orders which VERALANY suspects are not placed in good faith. We will not be liable to you or any third-party for refusing or suspending any transaction after processing has begun. If the creation of your custom item has begun, you will be liable for the cost.
After receiving your order(s), VERALANY will begin to create your custom item. A contract for the sale of Products between you and VERALANY will only be formed when VERALANY emails you confirming that the Product(s) is/are available and its/their creation has/have been commenced.
The contract is formed when VERALANY begin to make your product, whether or not you receive the said email.
The contract for the sale of Products will relate only to those Products whose production has been confirmed in the Confirmation of Production email. VERALANY will not be obliged to supply any other Products which may have been part of your order until the dispatch of such Products has been confirmed in a separate Confirmation of Production email.
In the Order Receipt Confirmation, you will receive a copy of these Customer Terms, however, you are encouraged to download, save and/or print a copy of your Order Receipt Confirmation and these Customer Terms for your records.
If you would like to amend or cancel your order before you have received your Confirmation of Production email, you must contact the VERALANY Customer Care Team as soon as possible. Whilst VERALANY will always attempt to amend or cancel your order for you, this may not be possible due to the speed with which orders are processed. If VERALANY is unable to amend or cancel your order and the Product(s) is/are being made, you may only return it/them in the event that it/they is/are faulty. See our Returns policy.
Prices, Shipping and Handling, Charges and Taxes
The price charged for a Product will be the price in effect at the time your order is placed and will be set out in the Order Receipt Confirmation and in your Shipment Confirmation.
In the event of a pricing error, whether on the VERALANY website or in an Order Receipt Confirmation or otherwise, you accept that VERALANY has the right to correct such error and charge the correct price or cancel the order. If the actual price is more than the amount shown on your Order Receipt Confirmation, VERALANY will notify you of the correct price and give you the option of proceeding with the order or cancelling it. Your sole remedy in the event of such pricing error is to cancel your order.
You acknowledge that even after VERALANY has sent you a Confirmation of Production email, if the pricing error is obvious and could reasonably have been recognised by you as an error, then VERALANY will be under no obligation to provide the relevant Product(s) to you at the incorrect (lower) price.
Prices for the Products include tax but do not include charges for shipping and handling. Separate charges for shipping and handling (and their related taxes) will be clearly displayed prior to the completion of your order and confirmed in your Order Receipt Confirmation.
Your order may also be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that VERALANY has no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.
Prices for Products and for shipping and handling are liable to change at any time, but changes will not normally affect orders in respect of which we have already sent you a Confirmation of Production (save in the case of a manifest pricing error as described above).
Discounts and Promotions
By using a discount or promotional offer you will be deemed to have read and understood these terms and conditions and agree to be bound by them.
The terms and conditions on the VERALANY website shall apply to discounts and promotions. If and to the extent there is a conflict or inconsistency between the terms and conditions of the VERALANY website and these promotional code terms and conditions, the promotional code terms and conditions shall prevail to the extent of the conflict or inconsistency. The defined terms used in the VERALANY website terms and conditions shall also apply to these promotional code terms and conditions.
VERALANY discounts and promotions can only be used on VERALANY and towards the purchase of items currently featured on the VERALANY site, excluding delivery charges.
Discounts and promotions cannot be used in conjunction with any other offer.
Discounts will run for a limited time period. VERALANY reserves the right to suspend, change or cancel any discount or offer, at any time, in the event of circumstances arising which make it necessary to do so. VERALANY may update these terms from time to time and reserves the right to add additional terms and conditions for specific offers as and where necessary. You should review these terms and conditions periodically for changes.
Discounts have no cash value, cannot be transferred and cannot be forwarded or reassigned.
Any refund you may be entitled to receive will not include the redemption value of the discount or promotional offer. You will receive no more than the amount you paid towards the final basket price.

Payment shall be made by one of the methods you have selected during the checkout process. We accept Visa and MasterCard.
In the event VERALANY does not receive the appropriate authorisation from your card or payment service provider, VERALANY reserves the right to reject your order.
Payment for your order, including all applicable taxes, shipping and other charges, will be settled from the applicable card or payment service once VERALANY has sent you the Shipment Confirmation.
You acknowledge that these Customer Terms, and/or any transaction made by you to VERALANY, do not create or imply any partnership, joint venture or trust relationship between us and you. All prices shall be shown in the applicable currency and payable in that currency. You accept that some banks may charge you an additional fee for certain transactions (for example, international transactions). You accept that item prices in the currencies displayed do not vary according to your location; delivery charges will vary depending on the destination to choose to have the item delivered.
You should allow 10 business days for the custom creation of your item. Standard delivery should take place 3 to 5 days after completion of your custom item. Please note this is an estimate based on shipping to addresses within major cities. Every country will vary and the more remote locations should expect a longer delivery time. VERALANY reserves the right to substitute another carrier of equal or lesser cost to deliver your order. The standard delivery described above is the only shipping option available for sales through the VERALANY website. VERALANY is unable to accept any special delivery requests.
If VERALANY cannot deliver your order within the period specified in your Order Confirmation, VERALANY will notify you as soon as possible.
If you defer delivery or delay the receipt of delivery after VERALANY has notified you that the carrier has tried to deliver the ordered items to you, or if you have provided VERALANY with an incorrect delivery address which results in an unsuccessful delivery, the delivery package will be returned to VERALANY, your order will be cancelled and a full refund will be issued to you.
Events Outside the Control of VERALANY
VERALANY shall not be held responsible for delay or failure to perform, if the delay or failure is caused by any act, event, non-happening, omission accident or circumstance beyond its reasonable control including but not limited to:
-civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;
-strikes or other industrial action;
-national or local states of emergency;
-interruption or failure of communication or transportation facilities;
-power or utility outages;
-non-performance by suppliers or subcontractors;
-earthquake, fire, explosion, storm, flood, subsidence, epidemic or other natural disasters;
-impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;
-the acts, decrees, legislation, regulations or restrictions of any government.
The time for VERALANY’s performance is deemed to be extended for the period that the above continues.
VERALANY uses reasonable efforts to ensure the availability of Products you order from the VERALANY website. However, Products are made available to purchase on a “first in-first out” basis and are only available whilst stocks last.
Compatibility, Product Information
Please take care when placing your order to ensure that the Products you purchase are compatible for the intended use. Please use the VERALANY website as your final point of reference when checking compatibility. In the event of a difference between the VERALANY website content and any other source of information the compatibility of Products as shown on the VERALANY website at the time of purchase will be seen as taking precedence.
If the Products you have received do not correspond to the ones you have ordered, or if your delivery is incomplete or damaged in transportation, please contact the VERALANY Customer Care Team for assistance without delay.
Title to Products
Ownership of the Products will pass to you only when VERALANY has received full payment in respect of your order, including all taxes, shipping and other charges. Until then, VERALANY retains full legal title to the Products. The Products will be at your risk from the time you take physical possession of them.
Return and Refund
Cancellations are only possible prior to the receipt of the Confirmation of Production email. Once your Product is being custom-made, you are bound to the sale.
As VERALANY Products are custom-made, returns will only be accepted in the case of a damaged or faulty product. Contact the VERALANY Customer Care Team within 14 days of receipt. Please allow 7 days from the day VERALANY receive the returned item to process the refund. The Products must be accompanied by the original sales receipt and proof of postage.
VERALANY will refund in full the price of Products that are faulty or not as described, together with all applicable delivery charges (including any premium paid for non-standard delivery), and any reasonable costs you incur in returning the item. Please keep postage receipts for verification.
Unless faulty, Products may not be exchanged.
If you do not return a Product (or, if a Product sent fails to arrive and you are unable to provide proof of postage), VERALANY reserves the right to refuse a refund.
Your legal rights in respect of goods which do not conform to the contract (for example, if they are faulty or not as described) are not limited or excluded by these terms.
Consumer Warranty (Guarantee)
THIS GUARANTEE GIVES YOU SPECIFIC RIGHTS. IT IS OFFERED AS AN ADDITIONAL BENEFIT TO YOUR RIGHTS UNDER LAW. YOU ALSO HAVE OTHER RIGHTS UNDER LAW WHICH MAY VARY FROM COUNTRY TO COUNTRY.
You can find out about your legal rights and remedies by contacting your local consumer advice service. In particular, the VERALANY website has a legal duty to supply Products that conform to the contract. Nothing in this guarantee will replace or lessen any of your legal rights or remedies.
Products sold by the website include a guarantee for Products which turn out to be faulty or not as described during the period set out below:
1 year from the original date of purchase.
This means you can request a repair or replacement free of charge if the Products turn out to be faulty or not as described during this period. VERALANY will repair your Product or replace it with a Product of identical or similar characteristics, except as set out below. VERALANY may at its option replace your Product under this guarantee whether or not a repair of your original Product is possible. If VERALANY chooses instead to repair your Product VERALANY may do so with new or refurbished components.
If the Product cannot be repaired or replaced within a reasonable time or without inconvenience, you may request a refund or price reduction. Refunds, if authorised, will usually be made using the same method originally used by you to pay for your purchase.
This guarantee is given to the original purchaser of the Product from the VERALANY website and is not transferable.
Please retain your order confirmation/invoice or pass on to the gift recipient as the original proof of purchase is the warranty. If a receipt is not available a credit card or bank statement showing the relevant transaction will suffice. This does not affect your legal rights.
This guarantee does not cover normal wear and tear, oxidation, stretching, or damages caused by accidents, abuse, misuse, acts of nature, water, flood, fire, lack of careful maintenance, use of non-VERALANY Products or theft.
Repairs (or attempted repairs) to Products made other than by VERALANY will void this guarantee whether or not damage has been caused by such repair or attempted repair.
If your Product is repaired or replaced by VERALANY under this guarantee, the new item will benefit from the remainder of the term of the original guarantee or 90 days from the date of replacement or repair, whichever is longer.
VERALANY warrants to you that any Product purchased from the VERALANY website is of satisfactory quality and reasonably fit for all the purposes for which Products of the kind are commonly supplied.
VERALANY is not responsible for indirect losses which happen as a side effect of your main loss or damage and which are not reasonably foreseeable by you or VERALANY, including but not limited to loss of anticipated savings.
These Customer Terms set out the full extent of the obligations and liabilities of VERALANY and VERALANY in respect of the sale of the Products via the VERALANY website. To the extent permitted by applicable law, there are no other warranties, conditions or other terms that are binding on VERALANY other than those set out in these Customer Terms.
To the fullest extent permitted by applicable laws, we disclaim responsibility for any harm resulting from your use of any part of the Service.
NOTHING IN THESE Customer Terms AFFECTS YOUR LEGAL RIGHTS AS A CONSUMER. TO THE FULL EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF VERALANY SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID FOR THE PURCHASE OF THE APPLICABLE PRODUCTS FROM THE VERALANY website.
This does not include or limit in any way the liability of VERALANY respectively:
-for death or personal injury caused by their negligence;
-for fraud or fraudulent misrepresentation; or
-for any matter for which it would be illegal for VERALANY to exclude, or attempt to exclude liability.
If any provision of these Customer Terms shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Customer Terms and shall be enforced to the fullest extent permitted by applicable law not affecting the validity and enforceability of any remaining provisions.

You may not transfer, assign, charge or otherwise dispose of a contract with VERALANY, or any of your rights or obligations arising under it, without our prior written consent.
VERALANY may transfer, assign, charge, sub-contract or otherwise dispose of a contract with you, or any of VERALANY’s rights or obligations arising under it, at any time during its term.
If VERALANY fails, at any time to insist upon strict performance of any of your obligations under these Customer Terms, or if VERALANY fail to exercise any of the rights or remedies to which it is entitled under these Customer Terms this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.
These Customer Terms and conditions and any document expressly referred to in them represent the entire agreement between VERALANY and you and supersede any prior agreement, understanding or arrangement between the parties, whether oral or in writing.
You acknowledge that, in entering into a contract with VERALANY, you have not relied on any representation, undertaking or promise given by VERALANY or any third-party or be implied from anything said or written in negotiations between us prior to such contract except as expressly stated in these Customer Terms.
Governing law and Jurisdiction
These Customer Terms and your purchase of Products from VERALANY through the VERALANY website shall be governed by and construed in accordance with the laws of Victoria, Australia without resort to its conflict of law provisions. Any dispute or claim arising out of or in connection with these Customer Terms or your purchase of Products from VERALANY (including non-contractual disputes or claims) shall be subject to the non-exclusive jurisdiction of the Victoria courts.
